Jeremy Bentham

A discussion of Ricardo's sustained relationship with James Mill as well as of hypotheses by such commentators as Halévy and Hutchison on a decisive philosophical influenco by Mill (eithr Scottish or Benthamite) on Ricardo's eocnomic methodology.

I try to reconstruct the hidden agenda of nineteenth-century British controversy between Utilitarianism and Intuitionism, going beyond the image successfully created by the two Mills’ of a battle between Prejudice and Reason. When examined in depth, competing philosophical outlooks turn out to be more research programs than self-contained doctrinal bodies, and such programs appear to be implemented, and indeed radically transformed while in progress thanks to their enemies no less than to their supporters. Controversies, the propelling devices of research programs, (...) are real-words affairs, and philosophers do not engage in them just for the sake of the argument, but in order to win, and alignments are defined on the basis of strategic and tactical requirements that cross the boundaries of disciplines. I suggest that good objections and counter-objections, and most of all amendments of doctrines, were incidentally produced in the course of the fight, and they were no less valuable because of their being more side-effects than sought-for discoveries. This is the first Italian translation of Bentham’s “Deontology”. The translation goes with a rather extended apparatus meant to provide the reader with some information on Bentham’s ethical theory's own context. Some room is made for so-called forerunners of Utilitarianism, from the consequentialist-voluntarist theology of Lebniz, Malebranche, John Gay, Thomas Brown and William Paley to Locke and Hartley's incompatible associationist theories. After the theoretical context, also the real-world context is documented, from Bentham’s campaigns against the oppression of women and cruelty (...) to animals to his projects of political reform. Another section illustrates the ideas from Bentham's followers as well as from nineteenth- and twentieth-century critics of utilitarianism. -/- . (shrink)

Probability is a central concept in utilitarian moral theory, almost impossible to do without. I attempt to clarify the role of probability, so that we can be clear about what we are aiming for when we apply utilitarian theory to real cases. I point out the close relationship between utilitarianism and expected-utility theory, a normative standard for individual decision-making. I then argue that the distinction between “ambiguity” and risk is a matter of perception. We do not need this distinction in (...) the theory itself. In order to make this argument I rely on the personalist theory of probability, and I try to show that, within this theory, we do not need to give up completely on the idea that a “true probability” exists. Finally, I discuss several examples of applied utilitarianism, emphasizing the role of probability in each example: reasonable doubt, the precautionary principle in risk regulation, charity, climate change, and voting. Élie HALÉVY (1870-1937), philosophe et historien des idées, fut professeur à l'École libre des sciences politiques, l'ancêtre de l'actuel Sciences Po. Comme son autre grand ouvrage, l'Histoire du peuple anglais au XIXe siècle, paru en six tomes de 1913 à 1932, les trois tomes de La formation du radicalisme philosophique, parus en 1901 pour les deux premiers et en 1904 pour le troisième, reflètent pour partie ses enseignements de l'Ecole libre consacrés à l'histoire britannique. Le premier tome, La jeunesse de (...) Bentham 1776-1789, étudie la doctrine utilitariste non seulement chez celui qu'on regarde comme son fondateur principal, Jeremy Bentham, mais aussi chez les nombreux auteurs qui, en Grande-Bretagne et sur le continent, en dessinèrent avant lui les contours. Le deuxième tome, L’évolution de la doctrine utilitaire de 1789 à 1815, montre comment l'utilitarisme revêtit la forme non seulement d'une école de pensée, mais aussi d'un mouvement pour la réforme économique, sociale et politique. Le rôle coordonnateur nouveau de James Mill, ainsi qu'une convergence de vues avec les économistes, qui poussaient dans le sens des réformes, marquèrent notamment cette évolution. Le troisième tome, Le radicalisme philosophique, continue d'étudier la transformation de l'école en mouvement après la fin des guerres napoléoniennes, lorsque celle-ci commence à engranger ses premiers grands succès réformistes. Bentham, James Mill et les autres penseurs utilitaires sont alors réunis sous l'appellation de philosophic radicals. Le terme temporel de l'ouvrage est le Reform Act de 1832, première étape vers la modernisation du système électoral, que la propagande de ce groupe ne contribua pas peu à faire aboutir. Quoique l'ouvrage d'Halévy vaille en premier lieu par l'immense savoir qu'il déploie, et le nombre et l'excellence des citations qu'il propose, il comporte aussi des thèses historiques et philosophiques originales. On peut citer parmi les premières la thèse, qui relie les trois tomes, voulant que l'utilitarisme britannique trouve sa forme achevée dans l'intervention sur la société, lorsqu'il se mue en radicalisme philosophique, et parmi les secondes, la thèse, énoncée au début du premier tome, voulant qu'il existe trois modèles dominants de jonction des intérêts individuels (la fusion sympathique, l'identification naturelle et l'identification artificielle). Une autre grande thèse, à la fois historique et philosophique, affirme en substance que l'économie politique classique serait un département spécialisé de la pensée utilitaire. La question de savoir jusqu'à quel point Smith, Ricardo et Malthus ont pu adhérer au "principe d'utilité" de Bentham est toujours débattue. En même temps que les élucidations apportées à ce principe, elle contribue à expliquer l'intérêt que les historiens de la pensée économique continuent de porter à l'ouvrage. L'auteur a participé à la réédition de La formation du radicalisme philosophique en 1995 par les Presses Universitaires de France (P.U.F.), suivant un projet collectif lancé par Monique Canto-Sperber. Dans le présent article, antérieur à cette réédition, l'auteur tentait de résumer brièvement un livre qui demeure irremplaçable en dépit d'une conception et d'un style quelque peu datés. (shrink)

My aim in this chapter is to push back against the tendency to emphasize Mill’s break from Bentham rather than his debt to him. Mill made important advances on Bentham’s views, but I believe there remains a shared core to their thinking—over and above their commitment to the principle of utility itself—that has been underappreciated. Essentially, I believe that the structure of Mill’s utilitarian thought owes a great debt to Bentham even if he filled in that structure with a richer (...) conception of human nature and developed it in more liberal directions. This commonality is revealed, in particular, in Mill’s own institutional designs and practical reform proposals in Considerations on Representative Government and related writings. If this is right, then the tendency of interpreters to highlight their differences rather than their similarities has been to the detriment of both Mill and Bentham scholarship, and so to our understanding of the rise of liberal utilitarianism. Chacun des trois tomes s'accompagne d'une postface, confiée au philosophe Jean-Pierre Dupuy pour le premier, au politologue Pierre Bouretz pour le second, et à l'économiste Philippe Mongin pour le troisième. Un travail de grande ampleur a été requis, d'une part, pour localiser les références de Halévy dans des sources plus récentes que celles dont il disposait, en particulier, s'agissant de Bentham, dans l'édition toujours en cours de ses œuvres, et d'autre part, pour traduire les très nombreux passages que Halévy citait en langue anglaise. Sophie Jallais et Mary Sokol se sont chargées de la première tâche et Jean-Pierre Cléro de la seconde. Prise après quelques années de circulation de l'ouvrage, la décision des P.U.F. d'en pilonner les exemplaires que ses responsables ne rachèteraient pas a semblé compromettre ce vaste travail. Mais grâce aux efforts du site québécois Les classiques des sciences sociales, et de son directeur Jean-Marie Tremblay, il est devenu possible d'accéder aux trois tomes électroniquement. Jeremy Bentham is often interpreted as defending a satisficing, rather than maximizing, version of utilitarianism, where an act is right as long as it produces more pleasure than pain. This lack of maximization is surprising given Bentham’s maximizing slogan ‘the greatest happiness of the greatest number’. Against the satisficing interpretation, I argue that Bentham consistently defends a maximizing version of utilitarianism, where an act’s consequences are compared to those of not performing the act. I show that following this version of (...) utilitarianism requires that one realizes the greatest happiness for all affected individuals. (shrink)

This response addresses a series of themes from my writings on imagination, on art, and on ancient philosophy.

In the two related works in this volume, Bentham offers a detailed critique of William Blackstone's Commentaries on the Laws of England. He provides important refelctions on the nature of law, and more particularly on the nature of customary and statute law, and on judicial interpretation.

Jeremy Bentham came to know Jacques-Pierre Brissot when he was in London between midwinter 1782–3 and summer 1784. They shared some opinions: Brissot indeed saw Bentham to some extent as his mentor. There was never complete accord, however; and Brissot's increasingly radical political views were not at that stage shared by Bentham. In any case, their ways parted with Bentham's prolonged sojourn with his brother in Russia between 1785 and 1788. It was revolution in France that brought renewed contact, though (...) no further personal encounters. By the winter of 1788–9 Bentham was writing, with France in mind, an increasingly elaborate work on parliamentary procedure; and by the spring Brissot was writing and publishing his account of the subject. One element in that work dealt with an issue on which Bentham vigorously opposed Brissot; for it included a strongly argued case for a declaration of rights – something Bentham had already attacked in 1776. He renewed that attack in a letter to Brissot in the late summer of 1789. By the autumn, however, writing to Brissot again, he raised a subject on which the two could sympathise – the importance of asserting popular sovereignty in the new French constitution. That sovereignty, Bentham insisted, must extend to the administration of justice – royal authority must be rigourously excluded from control of the judiciary. The judicial establishment in France was to be Bentham's predominant concern between the winter of 1789–90 and the following summer, and he now had assistance, especially from Etienne Dumont, in translating and publicizing his work. Brissot was probably – though there is no direct evidence – aware of these efforts. In the autumn Bentham's principal concern was the promotion in France of his scheme for a model prison – the Panopticon. That cause was helped by the cordial reception in the National Assembly of his judicial reform proposals. By then he was again in touch with Brissot, whose support he now sought for the Panopticon project – at first with some success. No progress was made in 1793, however, as Brissot's revolutionary career reached first its apogee and then its disastrous end. Many years later, as Bentham's life drew to a close, Brissot's Mémoires served to remind him of their uneasy partnership in the years of revolution. (shrink)

An unresolved debate in Bentham scholarship concerns the question of the timing and circumstances which led to Bentham's ‘conversion’ to democracy, and thus to political radicalism. In the early stages of the French Revolution, Bentham composed material which appeared to justify equality of suffrage on utilitarian grounds, but there are differing interpretations concerning the extent and depth of Bentham's commitment to democracy at this time. The appearance of Rights, Representation, and Reform: Nonsense upon Stilts and other essays on the French (...) Revolution, a new volume in The Collected Works of Jeremy Bentham, containing definitive texts of Bentham's writings at this crucial period, offers an opportunity to reassess this debate. First, Bentham's most radical proposals for political reform came not in the so-called ‘Essay on Representation’ composed in late 1788 and early 1789, as has traditionally been assumed, but in his ‘Projet of a Constitutional Code for France’ composed in the autumn of 1789, where he advocated universal adult suffrage, subject to a literacy test. Second, it may be doubted if the very question as to whether Bentham was or was not a sincere convert to democracy is particularly helpful. Rather, it may be better to see Bentham as a ‘projector’ during this period of his life. Third, the nature of Bentham's radicalism was very different at this period from what it would become in the 1810s and 1820s, for instance in relation to his commitment to the traditional structures of the British Constitution. Having said that, his attitude to the British Constitution remained complex and ambivalent. At his most radical phase, in the autumn of 1789, he advocated wide-ranging measures of electoral reform while at the same time harbouring aspirations to be returned to Parliament for one of the Marquis of Lansdowne's pocket boroughs. To conclude, it was, arguably, the internal dynamic of Bentham's critical utilitarianism, rather than the events of the French Revolution, which was ultimately responsible for pushing him into a novel form of radical politics. The youth of Bentham (1776-1789).--The evolution of the utilitarian doctrine from 1789 to 1815.--Philosophic radicalism.

This article in the journal 'History of European Ideas', examines Jeremy Bentham’s treatment of taste in his essays on sexuality, in the context of the historical development of the idea of taste as a singular practice with a broadly social character. My analysis of Bentham’s comments on taste in these essays, also engages with Bentham’s criticisms of David Hume’s writing on social standards of taste. Bentham’s essays on sexuality enable us to understand why he condemns Hume’s critical, and avowedly unprejudiced, (...) analysis of good and bad taste, with as much vehemence as he does the anti-democratic attitudes of ‘aristo-cratical’ taste. In his essays on sexuality, Bentham defines taste as a disposition to derive pleasure, that assumes meaning in a social context where human beings transact with one another to secure and increase their enjoyment. By this definition, judgments on good and bad taste are aspects of an anti-social practice that exerts a negative influence on what Bentham calls ‘an uncontrolled choice’ that links pleasure to utility. L’Autrice si propone di tracciare la genealogia della posizione neoliberale, partendo soprattutto dai testi di Gary Becker. Il pensiero economico neoliberale è posto in relazione con la rivoluzione scientifica e l’operazione di matematizzazione della natura che da essa scaturisce. Questo percorso porterà poi a Jeremy Bentham, il cui sistema è spesso visto come antesignano degli studiosi neoliberali. Secondo la tesi sostenuta dall’Autrice, il neoliberalismo presenta il proprio sguardo come una neutra e scientifica descrizione del reale, sennonché in tale mossa si (...) annida pur sempre una tendenza normativa. È così che gli economisti neoliberali elaborano un sistema che è altresì prescrittivo, proponendo un modello che si pone sul piano politico; modello il quale viene qui designato con il nome di «utopia economica».
