PRELIMINARIES
The foregoing `Preliminaries' items set out hereunder are applicable to the whole of the
works as on the Drawing and Specification. The Contractor shall allow herein the monetary
value for complying with each of the items in connection therewith. Such rates inserted in
these 'Preliminaries' items shall be deemed to apply to whole of the Works carried out
under this Contract. The Contractor shall has no right of not to perform and fulfill the
requirements of all item in this Preliminaries. If the contractor fails to carry out any of the
item specified in these Preliminaries, Then the Employer shall have the right to carry out
the same by appointing a third party to carry out the works and charges imposed by the
said third party will be borne by the Contractor by the way of deduction from the money
that become due via the progress payment.
Each Items/Clause shall be individually priced in INK. Bulk pricing for sections, trades,
groups or pages of Items/Clauses shall not be accepted and no subsequent claims for loss
of expense and/or profit shall be entertained for failure to comply with this Clause.
The S.O shall reserve the right to request from the contractor the detailed breakdown of
the pricing for Items/Clauses for examination and approval . The approved detailed
breakdown pricing of which shall then be used as a basis for the preparation of monthly
interim valuation.

PRELIMINARIES
Preliminary items will be paid in installments according to the progress of the pysical
Works as the work proceeds. Generally they will be paid in the proportion of the value of
work executed to the total value of works. However, at the discretion of the S.O. interim
payment in excess of this proportionate value may be made for any item if the amount
expended in respect of such item can be reasonably ascertained.
Definitions
In Tender Document the following words and expressions shall have the meanings hereby
assigned to them except where the context otherwise requires :-
"Works" means the works to be executed in accordance with the Contract.
"Contract" means the documents forming the tender and acceptance thereof including :-

"Contract" - shall mean the Work executed between the the Government and the
Contractor together with the documents forming part thereof and as in the Form of
Contract.

"Local Authorities" shall be deemed to include the relevant statutory bodies, supply
authorities and federal departments in so far as their approval and/or consent are
materials to the implementation of the Works or anything in connection thereof. Words
importing singular only also include plural and vice versa where the contract requires.
Headings in these Bills of Quantities and/or Specifications shall not be deemed to be part
thereof and shall not be taken into consideration in the interpretation on construction of
the Contract.
Parties
The word 'JPPMBRP' wherever appearing in this document shall mean and be read as
Jawatankuasa Penaja Pembinaan Masjid Bukit Rahman Putra
"S.O" shall mean the "Superintending Officer" who shall mean Pengerusi Jawatankuasa
Penaja Pembinaan Masjid Bukit Rahman Putra or his authorised representative.
"Architect" shall mean Messrs Sabraa Architect (SA). No. 43-2, Jalan Wangsa Delima 2A,
Seksyen 5, KLSC, Wangsa Maju, 53300 Kuala Lumpur. or his authorised representative.

"Civil and Structural Engineer" shall mean Messrs ATZ Consult Sdn. Bhd, No.27-G, Jalan
Nautika C U20/C
TSB Commercial Centre, 40160 Sungai Buloh, Selangor Darul Ehsan or his authorised
representative.
"Quantity Surveyor" means Messrs KAS Juruukur Bahan Sdn. Bhd. 12A Jalan Desa Ampang
16, Taman Rasi Ampang, 31450, Ipoh Perak Darul Ridzuan or his authorised representative.
"Planner" shall be refers to the name addressed in the drawing for each scope of works or
his authorised representative.
"Mechanical and Electrical Engineer" means Perunding Azfar. No 7, 1 & 7-2, Jalan 3/23a,
Danau Kota, 53300 Kuala Lumpur or his authorised representative.
"Contractor" means the person or persons, firm or company whose tender has been
accepted by the Employer and includes the Contractor's authorised representatives,
successors and permitted assigns.
The following Conventions shall be adopted for these documents:-
Wherever the terms "Superintending Officer" appears in the Contract Documents, it shall
mean "Pengerusi Jawatankuasa Penaja Pembinaan Masjid Bukit Rahman Putra and/or his
successor in office" in the Conditions of Contract and vice versa.
Wherever the phrase "as directed" or under the direction of the Superintending Officer
appears in the contract Documents it shall mean as the Contractor shall propose and as
the Superintending Officer shall approved"
Where the Contractor is required under the terms of this Contract to maintain temporary
works including providing measures, facilities and buildings, such maintenance will
apply from Date of Possession until the issue of the Certificate of Practical Completion of
the Works or when directed by the Superintending Office that such maintenance is no
longer the responsibility of the Contractor, the date for such decision not being
unreasonable.

The term "Current issue" will mean the latest issue or edition at the date of Tender
The term "The Authorities" will be held to include for all Government, QuasiGovernment,
Local Authorities or Departments and utility companies which has jurisdiction over any
section of the works.
Wherever the phrase "in accordance with the manufacturer's instructions" appears in the
Contract Documents, the Contractor will be held to have consulted the said manufacturer's
latest publications and to have allowed in his, the Contractor's Tender for complying with
all instructions, directions and recommendation contained therein.
Wherever the terms "making good" appear in the Contract Documents, such making good
will be at the Contractor's expense and is to be executed to the entire satisfaction of the
Superintending Officer
Wherever the phrase "cart (carting) (remove) off the Site" appears in the Contract
Documents, such carting etc., will be held to include for carting materials and goods to
dumps to be found by the Contractor, depositing materials and goods thereon, and for
paying all charges.
The works "as described" and "as specified" where used in these Bills of Quantities
mean as described and specified in detail in the Specification.

Descrepancies in Contract Document
The documents (including the drawings) forming the Contract are to be taken as mutually
explanatory of one another.
Discrepancy shall be referred without delay to the S.O. who may at his discretion issue to
the Contractor instructions directing in what manner the work is to be carried out.

-The Conditions of Contract (PWD203A Standard Form of Contract) shall take preference
over all other documents.
-Special Provisions to Conditions of Contract shall take preference over Condition of
Contract
-The Addendum Specification shall be preferred to the General Specification and
Drawings
-The Specifications and Drawings shall take preference over priced Bills of Quantities,
-Any discrepancy shall be referred or notified in writing as soon as possible to the S.O. to
obtain a ruling.
Pricing of Bills of Quantities
The Bills of Quantities are to be priced in Malaysian currency i.e.. Ringgit Malaysia
and sen. Pricing shall be in INK throughout. The sum of the amounts of all items of the
Bills of Quantities priced by the tenderer shall truly represent the amount shown in his
tender. The rates set down by the Tenderer against each item in the Bills of Quantities
shall be the full inclusive rates and prices for the finished work (unless expressly
provided to the country) and shall be held to include providing and delivering all
materials, unloading, cutting and waste on materials, storage, packing, carriage and
cartage, hoisting, all labour, setting, fitting and fixing in position, use of plant,
providing suspension, establishmen charges, profit and all other labour and everything
else necessary for the due and proper completion of each item
Where the tenderer leaves any item blank in the preliminaries or insert only a dash
(-)against any item in these Bills of Quantities the value thereof shall be deemed to be
included in the prices or rates of other items therein. No subsequent claim out of such
unpriced item / clause shall be entertain
No unauthorised alteration, addition or note entered in these Bills of Quantities shall
modify the printed text

Headings and notes appearing shall not by itself be deemed to be comprehensive and do
not modify the meaning of the items in the Bills of Quantities
Where Quantities in these Bills of Quantities are marked provisional, the works shall
be remeasured on completion basing on drawings certified as true and correct
representation of the completed works by the Superintending Officer
The requirement of the Measurement Amplification and Pricing Factors (JILID I; SEKSYEN
II- BAHAGIAN J) are to be taken into account when pricing these Bills of Quantities

It shall be the sole responsibility of the Tenderer to scrutinize the Tender Documents
supplied to him and to satisfy himself that they are exact copies as included in the Tender
Table Documents. Should any discrepancy be found between any such copy supplied to
the Tenderer, it shall be the sole responsibility of the Tenderer to apply to the the above to
have such discrepancy rectified before the closing date of tender.
The Contractor shall be deemed to have inspected and examined the site and its
surrounding and to have satisfied himself as to the nature and position of, means of
communication with, access to the site, the extent and nature of the Works, the nature of
the ground and sub- soil, the types of material to be excavated, the material and goods
necessary for completion of the works, the facilities for placing and moving of material and
plant, the accommodation he may require and in general to have acquainted himself with
all matters pertaining to risks, contingencies and all circumstances affecting the execution
and completion of the Works and shall be deemed to have allowed the same in the
Contract Sum.

Prior to his Construction the Contractor shall give full details of his proposed route,
construction etc. and shall only proceed to construct his alternative access after written
approval by the S.O. The Contractor shall comply to the conditions attached to such
approval by the S.O. and to any other future and additional conditions that may be
stipulated by the S.O.
The Contractor shall be entirely responsible as to the sufficiency, safety and convenience
of his own access road and that the grant of approval by the S.O. shall in no way bind the
S.O. to any liability with respect to claims or changes b any parties suffering loss or injury
arising from the Contractor's own access road. In the event that the the JPPMBRP provide a
main common access road the Contractor is given permission but the above provisions will
equally apply to this common access road.
Upon possession of the work site and before commencement of work, the Contractor shall
in the presence of S.O. and Consultants, take record photographs and written
notes of the formation levels, the adjoining roads, roadside drains and drain walls where
applicable and provide at no cost, one copy each of all record photographs and notes to
the S.O. and Consultants.
The Contractor in addition to the foregoing paragraphs shall, comply to these
general provision in the execution of his works :-
Liase and coordinate his works with the other Contractors and take all necessary
precaution to reduce disturbance either from causes arising from his own oversight or
those caused by other Contractors in the execution of their Works.
Protect, uphold, maintain in good condition and make good all disturbed work previously
or concurrently executed by other Contractors arising from the execution of his works.

The Contractor shall observe and comply with any regulation governing the
loading/unloading of or waiting by vehicle on public roads, highways and the like
including the carriage or any materials, protective coverings, warning displays etc., and to
pay for all costs invovled.
Claims will not be entertained by the S.O. for any extra costs incurred by the Contractor in
carrying out the works not specified herein, but the necessity for which could have been
forseen by him on inspection of the site before tendering.
Site Conditions
Immediately after taking possession of the site and before commencing work, the
Contractor shall check the actual levels and dimensions against those shown on the
drawings, and in the event of any discrepancy, shall immediately notify the S.O.

The Performance Bond (or any balance thereof remaining for the credit of the Contractor)
shall be released on the completion of the Works comprised in this Contract and shall be
refunded immediately upon the giving of the Certificate of Practical Completion.
The Contractor's attention is specially drawn to his responsibilities under Clause 14 and 15
of the Conditions of Contract.
The Contractor shall effect and maintain a `Contractor's All Risks Policy' in the joint names
of JPPMBRP the Contractor, their appointed Sub-Contractors and shall arrange the policy

with an Insurance Company to be approved by the JPPMBRP and covering particularly the
following:
Third Party Liability (RM1,000,00,00) on any one accident and unlimited during the period
of insurance and the total limit of indemnity is unlimited.
Injury and damage to property real and personal.
Cross Liability.
Extended Maintenance Cover (for Maintenance Period or Defects Liability Period and an
Additional of three (3) months plus 14 days Thereafter)
Extension of cover of extra-charges for overtime, night work and work on Public Holidays.
The insurance policy must be endorsed to cover injury to the Supervising Staff, the S.O.
Engineers, Quantity Surveyors, JPPMBRP,JAIS,PWS and their representatives.
No exccess Clause shall be specified in the policy or policies in effecting the above.

The Contractor will be required to produce all cover notes and receipts for premiums paid
in respect of all insurance for the inspection of the S.O. before the commencement of any
work in this Contract. Period of cover for the insurance shall be the full Contract Period
and extended to cover the Defects Liability or Maintenance Period Plus an additional of
three Months Plus 14 Days.
Pay such contribution as have become due and remain unpaid and deduct the amount of
such contribution from any money due or to become due to the Contractor.
Nothing in this Clause shall be construed to take away or to waive or any manner to
modify the right of the JPPMBRP to be indemnified by the Contractor in respect of all
compensation, costs and other expenses whatsoever which by reason of the Contractor's
default or otherwise become payable by the JPPMBRP under the said Legislation or other
law.
Note To Clause 16 - Indemnities to JPPMBRP in Respect of Claim by Workmen
The labour content shall be assessed to be not less than 10% of the costs of the Contract
Sum The Nominated Sub-Contractors shall effect and maintain separate policies to cover
their own workers.
Provided the Contractor will be required to take out any Workmen's Compensation
Insurance Policy if the Workers employed in the Works are liable for coverage under the
Employees Social Security Act 1969, the Contractor shall register his employees and

contribute under the Social Security Scheme (SOCSO) in the place where the scheme is
implemented and comply with the provisions of the said act. He shall submit the Code
Number and Insurance Number of all the workers on site to the S.O for checking.
The Contractor shall make payment of all contribution from time to time on the first day
on which the same ought to be paid and until the completion of his contract and upon
demand the Contractor shall produce to the S.O the last receipt for payment of such
contributions.

If any default is made by the Contractor in complying with the terms of this clause the S.O
may without prejudice to any other remedy available to the JPPMBRP for breach of any
terms of this Contract:
Withhold all payment which would otherwise be due to the Contractor under this contract
and out of such money so withheld satisfy any claims for compensation by workmen that
would have been borne by SOCSO had the Contractor not made default in maintaining the
constribution and/or
REGISTERED LICENSED LAND SURVEYOR
The Contractor shall submit the name of the registered Licensed Surveyor (LS), preferably
with experience in Jawatankuasa Penaja Pembinaan Masjid Bukit Rahman Putra JPPMBRP)
projects, witihn two (2) weeks from the date of the Site Possession for the consent and
clearence of the EC to undertake all the survey works as stated hereinafter.
The EC's consent and clearance,however, shall not relieve the Contractor's responsibility in
the terms of the related schedule, for which the Contractor shall allow in his Tender and
Contract Period.
Allow for engaging an approved Licensed Land Surveyor to perform the survey work in (ii)
and (iii) above, and other survey work ordered by S.O. to be carried out from time to time
for the proper execution of the whole entire Works including paying all fees and expenses.
The Contractor will be responsible for the accuracy of locating and positioning each pile
position, where applicable. Any errors in setting out and any consequential loss to the
Employer will be made good at the Contractor's expense to the satisfaction of the S.O.
Allow for providing theodolites, level and such like instruments and attendance for the S.O.
in checking of levels and setting out of the Works throughout the contract period.

Any assistance given by the S.O. in setting out will not relieve the Contractor of his
responsibility to set out the Works accurately.
Note To Clause 21 - Compliance with the Law Etc.
The Contractor shall give all requisite notices to the relevant Local Authorities and conform
in all respect to their requirements and obtain all licences and pay all fees, royalties or

charges including any rates or taxes legally demandable. All cost in connection with this
provision shall be deemed to have been included in the Contract Sum.
Where the quantities of the Works or any part thereof are stated as `PROVISIONAL' in the
Bills of Quantities, such quantities are the estimated quantities of the work and they are
not to be taken as the actual and correct quantities of the Works to be executed by the
Contractor in fulfillment of his obligations under the Contract.
The amount to be paid to the Contractor in respect of the said works shall be ascertained
by remeasurement and valuation of the Works as they are actually executed in accordance
with Clause 25 of the Conditions of Contract.
Note To Clause 28 - Payment To Contractor And Interim Certificates
All application for progress payments shall be accompanied by detailed lists of works done
and materials on site.
To facilitate approval of applications for progress payments the Contractor shall submit to
the Quantity Surveyor a copy of the delivery orders of all material delivered to site so as to
enable the Quantity Surveyor to check and verify the material supplied.

The S.O may by a certificate make any correction or modification of any previous
certificate which shall have been issued by him and the S.O shall have power to withhold
any certificate if the works or any part thereof are not being carried out to his satisfaction.

Construction Surveys And Interim As-built Surveys of Earthworks
The Contractor shall carry out the construction surveys by the Licensed Surveyor as
necessary for the proper construction and completion of the whole Works and for
justification of progress of work qualify for interim payment.
Note To Clause 35 - Materials , Goods and Workmanship
Materials and workmanship are to be the best of their respective kinds and "best"
shall be understood that no superior class of specified materials and workmanship
is available in Malaysia
Materials and Workmanship shall comply with the British Standard and Codes of
Practice wherever applicable and shall be approved by the S.O. The Contracto is not to
alter or amend any of the descriptions of materials in these Bills o Quantities and
except where expressly provided to the contrary, any offers o alternative materials
will render the tender liable to disqualifications. Wherever in these Bills of Quantities
any goods or materials are specified such are to be considered as being the
minimum standard acceptable. In the event of the S.O. allowing the substitution of any of
the materials during the course of the Contract, such substitution shall be accompanied
by a corresponding deduction in cos unless the S.O. otherwise directs

The materials of Malaysia Origin and/or locally manufactured materials shall be used by
the Contractor to the exclusion of imported materials and he shall allov. for this special
requirement in his tender. The locally manufactured materials are as listed in the 'Senarai
Bahan-bahan Binaan Tempatan', issued by Kumpulan IKRAN Sdn Bhd. (Forme\y known as
IKRAM) or those which comply with the relevant Malaysian Standard. Other local
materials shall be tested and certified b Kumpulan IKRAM Sdn Bhd for civil engineering
materials or approved by the S.O. or S.O.'s Representative for other materials before they
can be accepted for use in the Works by the S.O. Testing and certification by other testing
body may be allowed with the S.O's approval. If the Contractor fails to comply with
this requirement, the materials supplied shall be rejected and disciplinary action shall be
imposed upon the Contractor.
The Contractor shall place his orders for specified materials at the earlies possible
date after notification of acceptable of tender or at such times as may be specifically stated
elsewhere herein for any particular materials.
The Bills of Quantities shall not be used as the basis for ordering any materials
If the Contractor fails for any reason to supply any materials which he has contracted to
supply or if he fails to supply any such materials in sufficient time to enable the Contract to
be completed by the date fixed for completion, then in either event the Employer may
supply any portion of all such materials. If the Employer supplies such materials, the cost
in respect thereof which shall be borne by the Contractor shall be:- EITHER The current
market rates OR The actual cost to the JPPMBRP at the date of supply, plus 25% for
overheads and other charges. WHICHEVER IS THE GREATER.

The cost to be borne by the Contractor as detailed above shall be deducted from any
money due or to become due to the Contractor under this Contract and the Contract Sum
shall be adjusted accordingly; provided that any variation orde issued by virtue of this
clause shall not be taken into account when computing the final amount of this Contract
and no claim for loss of profit under clause 13 of the conditions of Contract shall be
deemed to have arisen. No action by the S.O. under this clause shall be deemed in any way
to affect or modify the right of the employer to calim or damages in the event of the
Contractor's failure to complete the Works by the date fixed for completion.
All costs of instruments, machines, materials sampling, transportation and works for the
testing of samples and completed works as required and specified and directed by S.O.
shall be borne by the Contractor. The Contractor shall be responsible for getting all
materials including water, electricity, etc. for the test to be carried out in the manner and
within the time as required and specified in the Contract.
Where the supply of electricity, water, etc for test runs and/or maintenance purpose are
obtainable from JPPMBRP sources, the Contractor must obtain the approval of the S.O. and 8,250.00
supply adequate meters and undertake to pay off the used electricity, water, etc.
The successful Contractor's attention is also drawn to the provision that the importation of
mild steel bars is subject to Customs Prohibitive Order (Import). Approval of import
licences from the Ministry of Commerce and Industry must be obtained before placing
orders with overseas manufacturers and the Contracto shall be solely responsible for
complying with this procedure.

licensed Land Surveyor to set out and to confirm points and bench marks, including

of the occurrence of the event/causes/ reasons for extension of time. Any submission
later than two (2) weeks after the occurrence of the events/causes/reasons for
tension may not be considered.
Conveyance of Plant and Materials On Site
The Contractor shall be arrange for the conveyance of materials, plants etc., so as to cause
a minimum of damage to existing roads and culverts.
The Contractor Shall be responsible for any damage caused by his lorries o workmen to
any existing roads, culverts, etc., from whatsoever cause arising i.e including caused by his
Nominated Sub Contractors and Suppliers and shall maintain, repair and reinstate same
to their original condition to the satisfaction o the S.O. or alternatively shall bear the cost
of such maintenance and restoration as a deduction from any money due or to become
due to the Contractor unde this Contract.

The Contractor shall on each working day furnish to the S.O., maintain and update a full
list of all his workers including all workers employed by his sub contractors or nominated
sUb contractor on the work site giving all particulars in the form as stated in the format as
approved by the S.O.

Before commencing any excavations for the purpose of carrying out work under this
Contract, the Contractor shall accompany the S.O. on a site inspection in order to consider
any circumstances which may indicate the presence of underground cables, water mains,
sewers or other services at or in the vicinity of such excavations.
If necessary, before commencing work, the Contractor shall give notice to the relevant
Local Authorities and arrange the temporary disconnection for diversion of such services
that may be effected by the Works.
Thereafter the Contractor shall carry out the excavations in such manner and sequence as
the S.O. may direct.
If during excavations the Contractor's workmen uncover any cables, water mains, sewers or
other services, work shall be stopped immediately and shall not be started again until the
matter has been reported to the S.O. who will issue whatever directions he deems
appropriate.
Protection of Existing, Adjoining and Adjacent Buildings or Properties

Before commencing any works under this Contract, the Contractor shall arrange for a joint
inspection of all adjoining and adjacent buildings and properties with the owner(s) or their
representative(s). S.O. and the insurance company from whom the relevant insurance
policies will be taken.
Photographs shall be taken on walls, floor slabs, aprons etc. and notes of thei condition
shall be recorded. Dated copies of these shall be extended to all parties concerned. The
Contractor shall request the owner(s) of the existing, adjoining and adjacent buildings and
properties to check and endorse the copies as being true and accurate description of their
present conditions. During the progress o the Works, the contractor shall arrange for
regular joint inspections of all existing, adjoining and adjacent buildings and properties.
The Contractor shall construct and maintain and subsequently remove on completion of
the Works all requisite shoring and support, etc. for the entire satisfaction of the S.O. and
Local Authorities and pay all fees and charges in connection therewith.
Advertising
The Employer reserves the sole right of advertising upon or adjacent to the Works. The
Contractor shall not allow and must ensure that no advertisement is displayed without the
written consent of the S.O.
Responsibility for Specialists
In the event of any specialist firms being employed by the Contractor to execute any part
of the Works under this Contract, the Contractor shall take full responsibility for any
damage or delay which may be occasioned by them as if he himself had undertaken the
works and shall idemnify the Employer from the consequences of anything that may
eventuate in connection with their employment.
Ordering of Materials
The Bills of Quantities are not to be used as the basis for ordering any material.

The Contractor shall allow for all expenses and fees (including costs of packing and
delivery of specimen and test reports) for necessary tests which the S.O. may direct the 3,300.00

Provide all requisite apparatus and equipment and skilled and experienced staff for the
purpose of carrying out all tests required by the nature of the work being executed in
addition to all the tests specified herein.

Provide within one (1) month of the date of Possession of Site a new telephone (the

Arrange for the conveyance of material, plant. etc., so as to cause a minimum of damage to
existing streets and roads.
The Contractor shall be responsible for any damage caused by his or his sub-contractors or
his suppliers transport vehicle or workmen to any existing streets and roads and shall
repair or reinstate same to their original condition to the satisfaction of the S.O. or
alternatively shall bear the cost of such repair or restoration.
Provide, maintain and remove on completion all necessary temporary traffic guide rails,
fences, signs, warning lamps, lighting, etc., for the safety of all pedestrian and motorists
and requirement of the Traffic Control Authorities.
Temporary Building
The Contractor shall provide and maintain a temporary shed, for use during the
execution of the works, at the location as directed by the S.O., remove them on 8,800.00
completion of the works and pay all charges in connection therewith.
These sheds and the fixtures therein shall remain the property of the Contractor on
completion.
- Adequate lock-up weather proofed shed for safe storage of building materials. Sheds
for storage of cement shall have the floor raised at least 300mm above ground level.
The Contractor shall also ensure that all emIBSion of smoke from his vehicles, plant and
machinery required for use on the works shall be kept to the required minimum level and
he shall be solely liable for any claims or legal proceedings arising thereof.

The Contractor shall submit to the Local Authorities in triplicate plans showing the location
of dumping sites and the transportation routes for any excess excavation. This shall be
accompanied by letter(s) of consent from the land owner{s) concerned together with the
land title(s) to prove ownership of the dumping site(s). The S.O. will also be provided with
a copy of the documents required.
The Local Authorities shall be informed in writing of the actual date o commencement of
earthworks and within one week of the completion o earthworks.
Security
The Contractor shall agree with the JPPMBRP on the security procedure to be adopted
during the construction period and once agreed, such procedures shall not be varied
without clearance from the JPPMBRP.
The Contractor are to allow under this item for the issuing of identification passes to the
workmen and any other security measures that may be required.
The Contractor shall provide all necessary watching by day and by night including warning
lamps during the whole currency of the Contract up to the defects liability period plus
another three ( 3) months
Environmental Protection and Enhancement
The Contractor shall at all times adhere to all existing statutes regarding protection
of the environment.
The Contractor shall be fully responsible for compliance with the legislation as stated in the
Scope Of Works and apply for all necessary permits, licences etc., renew if expired
throughtout the contract period.
Compliance to Government Requirements for Environmental Protection Works

Compliance to Government Requirements for Occupational Safety and Health
Provide within one (1) month of the date of Possession of site the Contractor shall comply
to JPPMBRP Requirements for Occupational Safety & Health to the satisfaction of the
Superintending Officer. The Contractor shall have studied and price Bill No 6 -
Occupational Safety and Health of the Bills of Quantities
Unless otherwise instructed by the S.0. in the event of the Contractor not clearing away the
above mentioned materials and plant, temporary services and buildings or other than
those which may be required as instructed, within the stipulated time, the S.O. shall be
empowered to perform such work, either employing a third party for such purpose or
dealing with such direct and all the costs of such clearing away shall be deducted from
the Contractor's Final Account.

The S.O. shall not be held responsible or liable for any material or plant left upon the site
by the Contractor after the taking over of the site by the S.O..
As Built Drawings
It is an important requirements of this Contract that As-Built drawings to be submitted as
work progresses. Upon completion of each stages of Construction Four(4) Sets of

approved as-built to be submitted to S.O. [ie. Earthworks, Piling Works, Structure Works
etc. for record purposes.
On completion of the whole works under this Contract, the Contractor shall submi six (6)
sets, four (4) sets blue print with tracing and two (2) sets in CD of As Built Completed
Drawings to the S.O. within 30 days after the Issuance of the Certificate of Practical
Completion ( C.P.C ). The As Built I Completed Drawings shall confirm that the Works are
wholly within the title boundaries. It is shall also show the exact position of the external
services and mechanical & electrical works.
Upon the physical completion of the whole Works and all associated works, the
Contractor's Licensed Surveyor shall compile all the interim As-built plans and combine
them in one (1) overall plan format.
The Contractor shall submit one (1) set of the said final overall As-built survey plan, within
two (2) weeks of the said physical completion, to the Employer's Consultant (EC) for the
perusal and comments/clearance first.
The EC's clearance, however shall not relieve the Contractor's responsibility in terms of the
related schedule, for which the Contractor shall allow in his Tender and Contract Period.
Within one (1) week after the EC's comment/clearance, the Contractor shall then submit
one (1) set each to the Employer, the EC and the Employer's Quantity Surveyor (EQS) of the
final overall As- build survey plan c/w endorsement by the Contractor's Licensed Surveyor.
PRELIMINARIES
The said endorsed final overall As-built survey plan shall be the basis for the EC's
certification of the Contractor's overall work done for the Final Payments as well as the
basis for the Issuance of the Certificate of Completion by the EC.
The As Built Drawings shall be signed and duly stamped by the professional consultant
who supervise the works prior to submssion to S.O. The As-Built drawings supplied shall
be comprehensive and to the satisfaction of the S.O. as to allow for complete
understanding of the services as regards to its operation, maintenance, repairs and
replacement.
The Contactor shall submit certified final survey drawings to S.O.
In the event the Contractor fails to submit the As Built Drawing within 30 days period,
the S.O. shall appoint another party to under take the above task and all cost incurred
shall be deducted from the Contractor.
The Contractor shall submit completed record drawings to Local Authority if requested
at their own cost.
The As Built Drawings shall be signed and duly stamped by the professional consultant
who supervise the works prior to submission to S.O.
The Contactor shall submit certified final survey drawings to S.O.
Protection Of materials and Completed Work
The Contractor shall provide all things necessary for the protection of materials and
completed works including of the nominated sub contractors and suppliers and shall
comply with all directions of the S.O. in this respect and reinstate at his own cost any
damage or loss incurred therefrom.
LOCAL AND OTHER AUTHORITIES NOTICES AND FEES
The Contractor shall be fully responsible for compliance with the local and othe
Authorities acts, notices apply for all necessary permits, licenses etc., pay all fee required,
display permits, licenses etc., renew if expired throughout the contrac period. He shall 8,800.00
pay and idemnify the JPPMBRP against any or charges demandable by law thereunder in
respect of the Works.

Prior to the issue of the Certificate of Practical Completion and handing over of the
completed works to the Superintending Officer, the Contractor shall make good all visible
and obvious defects to the satisfaction of the Superintending Officer.The Superintending
Officer will give the Contractor due notice of his intentions to carry out inspection during
the Defects Liability Period and the Contractor shall arrange for a responsible
representative to be a present at the time and dates nominated by the Superintending
Officer.This representative shall render all necessary assistance and take note of all matters
and things to which his attention is directed by the Superintending Officer.The Contractor
shall make arrangement with the Employer (through the Superintending Officer) and give
reasonable notice of the precise dates of access to the various parts of the works for the
purpose of making good defects and inform the Superintending Officer when remedial
works to the various parts are completed.
On completion of the works, and before the issue of the Certificate of Practical Completion
of the Works, the Contractor shall be responsible for the final cleaning and commissioning
of the works and for leaving the site in a clean and tidy condition to the satisfaction of the
S.O. Such operations shall include but not be limited to the following:
Remove all rubbish, debris etc. from the buildings and the site, clear away and remove
constructional plant and surplus materials, and leave the works clean and tidy and ready 5,500.00
for immediate occupation.
Remove any temporary markings, protective coverings, tapes, casings, still in position and
clean exposed surfaces.
