>> fairly significantly. i mean, a lot of my clients. >> are covert spies. >> for the united states. >> government. >> folks who work at the cia and elsewhere within the. intelligence community. >> and i cannot represent. >> them for the most part. now, i work a lot on anomalous health incident cases, what people know. as havana syndrome. i don't like the term, but that will explain it. >> and i. >> use my security. >> clearance to. >> represent many of those people, especially for whistleblowers. so it is. a key facet in what's going on. it i don't even look at it as harming me as much as it harms federal employees and workers who i represent. >> so, margaret, what is the argument you're making on behalf of mark in this case? and have you heard anything from the trump administration so far? >> sure, anna. >> so the security clearance adjudication process that's been developed over the past several decades in response to other president's executive orders, supreme court case law and other case law. and so the trump administration has basically ignored all of that and just summarily revoked mr. zaid's clearance. and so our lawsuit is basically asking a court to declare the march 22nd memorandum unconstitutional, to declare it unconstitutional as to mr. zaid and to rescind the revocation. and to answer your question, no, we haven't heard anything back from the trump administration yet. >> and, mark, as you've discussed, you're not the only one who's had your security clearance revoked. president also did the same for his predecessor, former president biden, as well as hillary clinton, just to name a couple. but what is the danger in this being used as a political punishment? >> well. that's a. >> real austere. >> list, and i. >> am honored, i. >> suppose. >> you know, to be. >> along presidents and vice presidents. >> and. >> attorney generals, etc. i'm not one of them. right. i'm not political. i have never been an elected official in the u.s. government. i've never. >> been. >> an appointed official. i'm a registered independent for my entire life, whereas everyone else there is political. so what this action has been is strictly a political, vindictive action against those who are perceived. or actually serving as adversaries against this administration. i've been holding administrations accountable since the clinton administration over 30 years. i do nothing differently from one administration, republican or democrat, to the next. the difference is this administration can't take that, apparently. >> so you believe you have been targeted because of being a perceived adversary? well, president trump was asked about that by our kristen welker about dissent and criticism. listen to his response. >> do you see dissent as an essential part of democracy? >> it's a part of democracy. it is. is it an. >> important part of democracy? >> you're always going to have kristen. you're always going to have dissent. there's nothing you're going to do about that. >> do you think. >> people should. >> have the. right to. criticize you without fear of reprisal? >> absolutely, i do that, i do. >> mark your reaction to that. >> well. >> trump the butcher is not speaking the truth. and i say trump the butcher, because dick the butcher was a character in shakespeare's henry the sixth who said, let's kill all the lawyers because the lawyers get in the way of authoritarianism. and that's exactly what's going on here. you know, he talks about essential. it's not essential. dissent is fine as long as it's not against him and his administration. so, you know, he already says when he talks about, for example, you know, ending the ukraine russian war. he just said it in jest, so you can't believe anything he says. actions speak louder than words. and if dissent was allowed, i would still have my security clearance. >> margaret, i have had for 25 years. >> right. and so, with this suit, what is the end goal here, margaret? >> you know, the end goal is that we preserve our adversarial system of government and the legal system generally. so, as mark said, this not only targets mark, this targets federal employees who would have turned to mark. it's also having the effect of chilling other lawyers from representing government employees. and that's something that we simply can't tolerate. and we hope the court will agree. >> mark, are you concerned that should you win, the trump administration will just ignore the ruling? >> i think that i've said that on this network that, you know, i think we are on the verge of a true constitutional constitutional crisis when the trump administration refuses a court order. we've already seen indications of that. we'll see what happens once the supreme court ruling is ignored. but i do think that is a real concern, just as we saw in president jackson, andrew jackson, way back in the 1830s administration. and there's a reason why president trump has a portrait of andrew jackson hanging in the oval office. >> and that's a. thank you so much for sharing your perspective, for joining us to talk more about your lawsuit.

>> very vindicated. and i'm not surprised that the rule of law prevailed in this particular case. i mean, this was an incredibly overbroad executive order. just to put it in context, right. it it's suspended. i had my clearance revoked. it suspended the clearances of everyone in the law firm, regardless of what they might have ever worked on or not. in fact, some of the lawyers who had their clearances ostensibly suspended did not have a clearance because they were lawyers. they had it because they were in the military, in the in the guard, in the reserves. so what did they do to to be punished in that way and to, of course, be banned from federal courts? i mean, it was obviously purely retaliatory and vindictive. and one of the things that judge pointed out was, in fact, that the law firms who capitulated and took the deal, that all of a sudden they went from being untrustworthy and a threat to national security. but because they made a deal with the administration, they can have their clearances back. >> so what should law firms be doing? obviously, this judge gave a scathing rebuke. there's been a lot of opinions about this. you had supreme court justice ketanji brown jackson, in fact, talking about more broadly, judges being targeted as well. what should law firms be doing in in light of what's happening? >> they should be standing up for the rule of law, right? we are not necessarily our clients. look, there are lawyers on both sides, many sides of the ideological aisles who maybe do push particular causes because that's what they believe in. most of us, i'm sure everyone is influenced in some way, but most of us, we're representing the client's interests. right? i don't think the aclu believed the nazi propaganda that they are clients were espousing. back in skokie, illinois, in the late 1970s. it was standing up for the rule of law, and it very much was the quote from shakespeare that judge howell mentioned, which i've mentioned on your show before about dick the butcher, because the notion was, we always think that this is a negative towards lawyer. it was a shakespearean compliment because the lawyers were preventing an authoritarian dictator from coming into power, because that's what we do. >> i want to highlight what was said by this judge who had opinions of the law firms that trump was targeting. she writes, those who stood up in court will be the models lauded when this period of american history is written. that's obviously her view. and many people are looking at this issue and the capitulation. you talk about. but sometimes those who stand up, as you well know, in the practice you're in and the world we live in face consequences. what will they be here? >> look. well, standing up, i mean, i've already started to suffer the consequences. there are certain clients i can no longer represent because of a lack of clearance. i would normally represent covert case officers at the cia who have nothing to do with politics. it's just dealing with personnel, employment issues. >> and mark, just to be clear for everyone, your lack of a clearance means that you cannot review documents or review material that would be helpful in either their litigation or in defending or being a litigant in the matter. right. that's the crux of why it means something. >> right? i mean, a decade ago, i represented. multiple. cia employees who were in benghazi when the ambassador was murdered. and, right, this was a huge republican talking point, blaming hillary clinton. well, i represented those individuals who were in the movie in the book 13 hours. i represented them through all sorts of classified hearings. i worked alongside of devin nunes, the then congressman who is now running trump's truth social media enterprises. i was working as a lawyer representing these individuals to protect their interests as lawful whistleblowers. it didn't make a difference what the politics was. as the republicans attacked hillary clinton, i you know, i stood there and i just made sure that my clients stuck to the facts because that's that's what the case was about. >> well, this judge makes clear what they believe the case is about. i wonder what the supreme court or other courts will find as well. mark zaid, thank you so
