APPLICATION FOR CONDONATION OF DELAY

I, Mr. Nasir Umar Pipulkar, Indian Inhabitant , residing at above mentioned


address do hereby state and submit that I had filed complaint U/s 138 of N.I.Act
against above named accused before 31st Court Vikhroli , Mumbai on 10th July 2009

I say that after verification statement the Hon’ble Court was pleased to issue
summons to the accused / respondent above named.

I say that accused did not remain present before Hon’ble 31 st Court therefore
Hon’ble Court pleased to issue warrant against the accused/ respondent.

I say that after service of the warrant through the Sakinaka Police Station.. Court
was waiting for the report of the said police station.
I say that the matter was adjourned on 20/9/2011 which was in 31 st Court ,
Vikhroli and since the report of the police was not available matter was adjourned to
2/11/2011 in 31st Court Vikhroli.

I say that though on 20/9/2011 matter was typed in the daily board of 31 st Court ,
Vikhroli the said matter was not traceable in the said Court. Therefore since then myself
and my advocate were regularly enquiring with the staff of the 31 st Court , Vikhroli, but
except matter is not traceable no answer was given to us.

I say that on April,2012 I made an application for certified xerox copy of the daily
road dated 2/11/2011. Here I came to know that the matter was transferred to 73 rd
Court, Vikhroli . When I enquired 73 rd Court Vikhroli I came to know the matter was
dismissed on 18th Jan . 2012. I say that without my fault and the mistake of the staff of
31st Court , matter was dismissed.

I say that I came know that on 4 th April 2012 the matter was dismissed I could not
collect the certified Xerox copies of the order dated 18 th Jan. 2012 as I out of Mumbai in
the moth of April and May for business purpose. Therefore 85 days delay may be
condoned . If the delay is not condoned I may suffer irreparable loss.

And this act of kindness I shall as an duty bound ever pray.
