This pertains to a parcel of land involving collective CLOA No. 135 located at Brgy. Aragon, Cateel, Davao
Oriental.
BACKGROUND/FINDINGS:
1. The subject property of this report is Lot 1871-B of Transfer Certificate of Title No.
CLOA No. 135, a parcel of agricultural land located at Brgy. Aragon, Cateel, Davao Oriental, registered
in the name of Eleodoro I. Buca, et al, consisting an area of ONE HUNDRED FORTY SIX THOUSAND
THREE HUNDRED FIFTY-NINE (146,359) square meters, more or less, issued on December 13, 1990.
In the title, the subject CLOA is located at Brgy. Aragon but in actuality, the said landholding is located
within the territorial jurisdiction of Brgy. Aragon and Brgy. Maglahus of Cateel, Davao Oriental.
2. The subject Lot 1871-B was originally awarded to ELEODORO I. BUCA, with an area
of SIX THOUSAND SIX HUNDRED TWENTY (6,620), more or less. However, annotated ARB
ELEODORO I. BUCA already abandoned the lot and executed an Affidavit of Waiver of Rights in
favor of the Republic of the Philippines, notarized by Atty. James Ian A. Generale under Doc. 233;
Page 48; Book No. VII; Series of 2022, stating such fact, attached in the Petition as Annex “C”;
3. In 2021, Petitioner JESSIE D. MADANLO took over the said lot, cultivated, tilled and
made it productive since then. In fact, the area is fully developed with coconut trees, the dominant crops
found in the subject area (attached hereto are the photos of Petitioner in the subject area);
4. As a result of the SPLIT validation process, SPLIT Field Validation Team (FVT) further
reported that indeed Petitioner JESSIE D. MADANLO is the actual tiller and occupant of the subject lot;
5. To verify the same, during the on-site inspection and investigation of DARMO Manay in
the subject area, it was also found out that Petitioner is the actual occupant and tiller of the subject lot;
6. Based on the open testimonies of the other adjacent occupants, and on the Certification
issued by the BARC Chairman Aristeo C. Batao of Brgy. Maglahus, JESSIE D. MADANLO is indeed
the one tilling, cultivating and making the subject lot productive since 2021 and annotated ELEODORO
I. BUCA has already abandoned his lot and waived his right over it in 2022.
RECOMMENDATIONS:
Considering the above-findings, it is most respectfully recommended that Lot 1871-B be re-allocated to
JESSIE D. MADANLO and to amend CLOA No. 135 to reflect his name and to remove the name of
ARB ELEODORO I. BUCA, due to his waiver of rights over his awarded lot, in accordance to
Administrative Order No. 2, Series of 2009.
